Pete Gardner is a Chartered Legal Executive in Spratt Endicott's Debt Recovery Department. He specialises in debt recovery matters that are subject to Court Action, which can involve matters on the Small Claims Track and the Fast Track as a Claimant or Defendant.
As a qualified Fellow of the Chartered Institute of Legal Executives, he was recently interviewed by the freelance journalist Dan Bindman for an article entitled 'Can't pay or won't pay?' The article was published in the January 2013 issue of CILEx Journal and discusses how debt recovery practitioners pursue claims on behalf of business clients in the challenging environment of a 'double dip' recession.
Pete stated in the article that "Now that budgets are clearly tighter and credit control departments are having to justify what they spend, there is a greater willingness to settle."
He reports that 90% of defended cases settle at a very early stage, because "clients now prefer to have at least some of the money back without the expenditure and litigation risk of a trial ... we have to be much cleverer with working out which debtors will not be able to pay no matter what happens at trial, or with enforcement."
