Intellectual Property

Businesses develop through creative effort and various works created by innovative individuals. That ingenuity and innovation must be protected to ensure that your business survives in today's competitive world.

Where you or your business have created or commissioned works protected by Intellectual Property rights, you must ensure that those rights are managed properly and that your business either owns or has permission to use the Intellectual Property or can grants rights to others. Our Corporate Team deals with:

  • Patents, registered and unregistered designs (UK and EU), trade secrets and licencing agreements
  • Branding issues including trademarks, infringement and passing off
  • Confidentiality and Freedom of Information issues, to include Data Protection
  • Copyright

Infringement of Intellectual Property Rights inevitably requires that action is taken as soon as practicable. It is essential to prevent further infringement to minimise the loss and damage to your business.

Many disputes are resolved by seeking and obtaining undertakings from anyone infringing your Intellectual Property Rights. However, this is not always appropriate and often urgent applications for injunctive relief can be made to stop further infringements, to obtain delivery of offending goods and details as to whom the goods have been supplied. It is necessary to ensure that such action is proportionate and economic. In our experience the obtaining of an injunction will often be the end of the litigation. In some cases there may be a claim for damages on account or profits and that may be dealt with later.

At Spratt Endicott we have an experienced team who can assist you with all types of infringements of Intellectual Property Rights.
