Terms and Conditions for the Spratt Endicott Silent Auction

  1. The Spratt Endicott Silent Auction (“Auction”) is held by Spratt Endicott Limited (“SE” or "we") whose registered office is at 52-54 The Green, Banbury, Oxfordshire, OX16 9AB.
  2. By bidding in the Auction each bidder agrees to be bound by these terms and conditions (“Terms”).
  3. All proceeds of the Auction will be donated to Katharine House Hospice (registered charity number 297099)
  4. The Auction will open at 9:00 GMT on 1 December 2017 and close at 17:00 GMT on 15 December 2017 (“Auction Period”). Bids received outside of the Auction Period will not be considered.
  5. Bids must be placed by email at: KHHAuctions@se-law.co.uk or KHHAuction@se-law.co.uk or by such method SE may specify.
  6. All bids must be made in pounds sterling (“Valid Bid”). There is no limit on the number of prizes that bidders may bid on or bids bidders may make.
  7. By submitting a bid, you acknowledge that we shall retain details of your name, email address, the amount of your bids, any address of telephone number you may provide and any information which may be contained in your email signature. If you are successful, we shall contact you for further details in order to dispatch the item you have won. Your details shall only be used for the purposes of the silent auction. We do not share your details with any other party, and all emails received shall be deleted on or before 31 January 2018.
  8. A Valid Bid constitutes an offer which, on acceptance by SE, will form a binding agreement. All Valid Bids will remain valid until payment for the prize has been received in accordance with these Terms. Payment will be required as soon as reasonably possible after winners have been contacted so please do not make bids which you cannot make payment for. Bids may be withdrawn before the Auction closes by contacting either of the email addresses specified in clause 5.
  9. SE has absolute discretion to reject any bid (including Valid Bids). Any bids that are rejected will not be considered Valid Bids for the purpose of this Auction.
  10. SE will not be responsible for any bids that are lost, late or incomplete or have not been transmitted due to computer error or any other error beyond SE’s reasonable control. Proof of submission is not proof of receipt.
  11. The highest Valid Bid for each prize will win. In the event of a tie for the highest Valid Bid, the highest bidders will be asked to resubmit new bids until there is a single highest bid.
  12. The winners will be selected and notified by email or telephone in the week commencing 18 December 2017. Unsuccessful bidders will not be contacted. The winning bidder for each prize will be asked to make immediate payment to Spratt Endicott by debit or credit card to a specified account or by cash. If payment is not received in cleared funds within 14 days of notification, we reserve the right to terminate the contract with the highest bidder without liability and the winning bidder will forfeit their prize. The second highest Valid Bid for the same prize will then be selected as the winning bid.
  13. Only the winning bid for each prize will be processed. The amount of the winning bid shall be inclusive of VAT. No money will be collected from any unsuccessful bidders.
  14. SE accepts no liability if any prize is lost or delayed.
  15. Prizes are not transferable and may not be exchanged for cash or for another prize. No refunds will be issued once payment has been made for a prize.
  16. SE has attempted to describe and catalogue items in good faith and correctly but provides no warranties or representations in respect of any of the prizes or descriptions.
  17. Prizes may be subject to any entry or eligibility criteria imposed by any donors or suppliers.
  18. SE may cancel the Auction at any time prior to the winning bids being selected and the Auction may be withdrawn if no Valid Bids are received.
  19. SE will process any personal data fairly and lawfully and in accordance with the principles of the Data Protection Act 1998. Save where required by law or court order to share your personal data with a third party, the police or other law enforcement authorities, SE will only use your personal data for the administration of the Auction, will not share your personal data with third parties (except in relation to the winners, whose contact details may be passed to the Donors to enable the winners to enjoy the prize) and will destroy your personal data within 12 months of the completion of the Auction.
  20. SE’s decision on the Auction and the conduct of the Auction shall be final and binding.
  21. If any provision or part-provision of ​these terms is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of these terms.
  22. These terms do not ​create or confer any rights under the Contracts (Rights of Third Parties) Act 1999 on any person who does not take part in the Auction.
  23. These terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.
  24. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these terms or ​their subject matter.

Terms and Conditions for the Spratt Endicott Raffle

Tickets for the raffle will only be available for purchase at ​the Christmas drinks party event, held on the 6th of December, 2017 at the Great Barn, Aynho. Winners will be drawn on 7 December and contacted by the close of business on 8 December 2017.
