Under the provisions of the Housing Act 1988 there are eighteen different grounds upon which a landlord can rely when seeking a Possession Order for their property which their tenant occupies under an Assured Tenancy agreement (whether Shorthold or otherwise). These grounds are listed in Part 1 of Schedule 2 of the Housing Act 1988 and can be categorised as those grounds where the Court must make a Possession Order (a mandatory ground) if the ground is made out, and those grounds where the Court may make a Possession Order (a discretionary ground) if the ground is made out and it considers it is reasonable to make such an Order.
