Family Law Review Opens Up Mediation For Families

Spratt Endicott’s Patrick Mulcare advises separating couples to consider mediation

In light of a family justice report commissioned by the Government, Spratt Endicott’s Patrick Mulcare continues to advise parents going through separation to consider mediation as a solution to ensure their children will have an ongoing relationship with both parents.

Mediation is a confidential way of resolving disputes following the breakdown of a relationship between two or more parties. This is done through a third party, the mediator, sitting down with both parties to help them negotiate a settlement.

Patrick Mulcare confirmed that the Government’s Family Law Review could encourage parents who might be separating to consider mediation as a suitable option.

“According to the Office for National Statistics, in the UK, one in three children does not live with their father. The government’s review of family law is in answer to this and will work to ensure that children in that situation get to spend more time with their fathers. However, reaction to the government’s planned review has been mixed. The suggestion that a child could have the right to see its father has been welcomed but, at the same time, concerns have been raised that each case be considered on its own merits and that the child’s needs, not that of the parents, are paramount. Through mediation, the third party mediator listens impartially to the couple’s individual concerns and helps them consider the needs of any children. Then, the mediation process can help produce a mutually acceptable comprise that suits all parties and allows the children to continue having a relationship with each of their parents.”

With increasing numbers now turning to mediation, Spratt Endicott recently launched its own Family Mediation service, allowing mediation clients to seek a safe and unbiased way to resolve issues by talking through their concerns in an open and honest environment. Mediation is provided as an external service, to both clients and other law firms, in addition to collaborative law and traditional court-based family law solutions, as part of Spratt Endicott’s new service offering.

Patrick, a solicitor within Spratt Endicott Solicitors’ Family Law department, concluded: “Before going to court to settle a dispute over matters concerning a child, our specialist Family Law Department always recommends trying mediation. Mediation is an ideal solution as it provides a safe and impartial environment for couples to discuss their concerns, consider their options and then reach agreements that suit all concerned.”
