Kyle Wyness to Speak at National Landlords Association Meeting this Wednesday

Spratt Endicott's Property Litigation specialist Kyle Wyness will be speaking at the National Landlord's Association Oxford Branch Meeting to be held tomorrow, Wednesday the 18th of June.

The title of Kyle's talk will be "Deposits and Possession - A Case Law Update", and it will focus on the two landmark cases of Superstrike Limited -v- Marino Rodrigues [2013] EWCA Civ 669 and Spencer -v- Taylor [2013] ECA Civ 1600.

Superstrike Limited -v- Marino Rodrigues confirms the position that when a contractual fixed term Assured Shorthold Tenancy comes to an end and a statutory periodic Assured Shorthold Tenancy arises, the latter is a new tenancy.  This gives rise to a number of questions relating to the landlords’ obligations to protect a tenancy deposit under the Housing Act 2004, particularly relating to whether there is a need for the deposit to be “re-protected” and the prescribed information “re-served” when that new tenancy arises.

Spencer -v- Taylor corrects the long held (and as it turns out inaccurate) view that it is necessary for landlords to comply with the requirements of section 21(4)(a) of the Housing Act 1988 when serving a Notice Requiring Possession in circumstances  where a contractual fixed term Assured Shorthold Tenancy has come to an end and a statutory periodic Assured Shorthold Tenancy has arisen.
