Leasehold Enfranchisement

This is a complex and detailed area of law. Residential leasees have the right to buy the freehold of their building if they meet certain qualifying criteria.

Our team will:

  • Advise on exercising the right to enfranchise
  • Prepare and serve the requisite notice
  • Work with our Property Department who deal with the conveyancing formalities

If after service of the requisite notice and any counter notice, parties are unable to negotiate a price for the property, we can then make an Application to the Leasehold Valuation Tribunal. The Tribunal will list a hearing, where the price will be determined. 

How our links with surveyors can help you

We find the vast majority of matters settle prior to the hearing date.  We have good links with surveyors, who can produce a report on the assessment on the property, including details on the:

  • Marriage value
  • Capitalised value of the ground rent
  • Value of the freeholder’s reversion at the expiration of the lease
