Spratt Endicott's Property Experts Help Local Residents in Their Fight Against HS2

Spratt Endicott Solicitors have successfully helped a local resident to sell their home and move on with their lives, despite having lived under the threat of HS2 since 2010.

Spratt Endicott’s property specialists provided expert legal advice in a case that is believed to be one of the first properties to have been purchased by HS2 via a Blight Notice.

David Inch, Partner, worked closely with a local property agent during this process, and demonstrated his knowledge of the complex and lengthy legal processes associated with this type of claim.  The result is that not only did the owners of the property receive the full market value for their house, they also received a home loss payment and all of their costs, not only in relation to their sale, but their purchase of an alternative property.

Since 2010, the owners of the property, located to the north of Chipping Warden, had to live with the prospect of their house being demolished during the construction of the HS2 railway, which is anticipated to gain Parliamentary approval in 2015.  The property, however, fell within the Safeguarded Area, which runs 60 metres either side of the railway.  Their agent advised the owners that there was an opportunity to submit a Blight Notice, which, if successful would force HS2 to buy their property immediately, rather than at a date which fitted into HS2’s construction timescale.
