We advised an Employer client over a period of 6 months on a sensitive situation regarding an employee with stomach cancer. This included advice on medical opinion as to reasonable adjustments under discrimination law, consultation for said employee and data protection issues.
The advice that we had to give had to be practical and sensitive and covered advice regarding dealing with the team the employee was working in, as well as the employee themselves to avoid what could have been an expensive Tribunal claim. The matter concluded with no claims being brought. This was a particular relief to the client because the potential compensation (if a tribunal claim had been brought) could have been uncapped.
We led an Employment Tribunal claim for an employer client covering wrongful dismissal, automatic unfair dismissal and detriment claims on whistleblowing and trade union membership. The value of the claim was around £100,000 and involved full preparation of a legally complex case.
The full hearing was listed for 4 days, which was successful on all counts for our client. The client was very pleased with the result which ensured that we still has a 100% success rate in Tribunals.
